Abstract:
The Constitutional Court is one of the actors of judicial power besides the Supreme
Court. Judicial power is an independent power to administer the judiciary in order
to uphold law and justice. Thus, the Constitutional Court is a judicial institution, as
a branch of the judicial power, which adjudicates certain cases which fall under its
authority based on the provisions of the 1945 Constitution. Formulation of the first

criminal law, civil law and constitutional law, using a historical approach

yang kemudian disepakati para hakim konstitusi menjadi hari lahir MKRI, Sejarah
berdirinya lembaga Mahkamah Konstitusi diawali dengan diadopsinya ide
Mahkamah Konstitusi (Constitutional Court) dalam amandemen konstitusi yang
dilakukan oleh Majelis Permusyawaratan Rakyat pada tahun 2001 sebagaimana
dirumuskan dalam ketentuan Pasal 24 ayat (2), Pasal 24C, dan Pasal 7B
UndangUndang Dasar 1945 hasil Perubahan Ketiga yang disahkan pada 9
Nopember 2001. Ide pembentukan Mahkamah Konstitusi merupakan salah satu
perkembangan pemikiran hukum dan kenegaraan modern yang muncul di abad ke20.
