Abstract:
The dissolution of political parties in Indonesia has its own problems. This problem
can be seen from the conditions required in the Law on the Constitutional Court
and the Law on Political Parties relating to matters that can dissolve political
parties. These requirements are considered not to have a good foundation in
dissolving political parties, even appearing that they cannot touch on substantive
matters so that political parties can be dissolved. Apart from that, there is a much
more important problem that is not touched by the law, but in fact damages the
value of the goals of political parties and the state in general, namely corruption.
Therefore, this paper will discuss the substantive weaknesses of the requirements
proposed by the two laws above. So that in addition to adding a new repertoire of
legal science in Indonesia, especially in the field of constitutional law. This paper
is also expected to provide new ideas on the requirements for the dissolution of political parties in Indonesia. The method used in this paper is normative juridical,
with the data source used is secondary data sources consisting of primary legal
materials, secondary legal materials and legal materials. tertiary. This research
was also conducted using several approaches, such as; statutory approach,
conceptual approach, historical approach.
