INTEGRITAS PEMILIHAN UMUM INDONESIA DALAM UNDANG-UNDANG DASAR 1945

Abstract

The history of general elections in Indonesia was not born from the womb of the 1945 Constitution, but from the Provisional Constitution, which at that time used a parliamentary system. Due to the needs of the state which was exemplified during the validity period of the UUDS at that time, after Indonesia's return to the 1945 Constitution, through a long journey of reform in 1998, then the 1945 Constitution began to be amended one by one. This study aims to determine elections with integrity within the framework of the constitution. This study uses normative juridical research based on secondary legal materials, namely from laws and literature, which are then analyzed descriptively qualitatively. The results of this study explain that general elections have integrity when the Indonesian constitution was amended in 2001, namely the third amendment, by bringing to life Chapter VIIB which specifically deals with general elections. The constitution really revives its dignity as the highest legal value in the state, which consists of values; direct, public, free, confidential, honest and fair.
