The state is the highest organization in the life of the people in a region. As an&#13;
organization, the state has goals that are contained in the state constitution. In order to&#13;
realize the goals of the state, it is necessary to form a government structure. In the present&#13;
context, the state does not only act as a night watchman, which is only to maintain order&#13;
and carry out the law, but more than that, the state has a duty to prosper its people.&#13;
Bureaucratic reform has been widely recognized in Indonesia both at the conceptual and&#13;
practical levels. The term bureaucratic reform is known as state administration reform,&#13;
which is a terminology that covers the political, economic, legal, social, cultural to&#13;
defense and security domains; legislative, executive, and judicial.
Negara merupakan organisasi tertinggi dalam kehidupan masyarakat&#13;
dalam suatu wilayah. Sebagai sebuah organisasi, negara, memiliki tujuan yang dimuat dalam konstitusi negara. Guna merealisasikan apa yang menjadi tujuan&#13;
negara maka perlu dibentuk sebuah susunan pemerintahan. Dalam konteks&#13;
kekinian negara tidak hanya sekedar bertindak sebagai penjaga malam yakni&#13;
hanya sekedar menjaga ketertiban dan melaksanakan hukumtetapi lebih dari itu&#13;
negara memiliki tugas untuk mensejahterakan rakyatnya. Mahfud MD,&#13;
menyebutkan bahwa untuk mencapai cita-cita atau tujuan nasional tersebut perlu&#13;
disepakati dasar-dasar organisasi dan penyelenggaraan negara1

Money politics in general elections and regional head elections continues to&#13;
be an interesting problem to be discussed but has the power of resolution&#13;
which can be said to be weak. As we know that law will run well when three&#13;
main factors work well, namely the substance of the law, legal structure and&#13;
legal culture. If viewed based on the substance of the law, money politics&#13;
regulation in the election law has accommodated the legal needs. However,&#13;
there are important things that should be noted together, which are related to&#13;
the elements of TSM that must be fulfilled so that it can be said as money&#13;
politics with disqualification sanctions. In addition, the legal culture as an&#13;
element of the legal system is of particular concern in the enforcement of&#13;
money politics in this paper. No matter how good the regulations and how many law enforcement agencies elect the regional head, if not accompanied&#13;
by a good legal culture, then the law enforcement will only be in vain.
Berdasarkan teori ketatanegaraan Indonesia, pesta demokrasi&#13;
berlangsung dengan dua sistem pemilihan. Pemilihan umum untuk memilih&#13;
Presiden dan Wakil Presiden, Anggota Dewan Perwakilan Rakyat, Anggota&#13;
Dewan Perwakilan Daerah dan Anggota Dewan Perwakilan Rakyat Daerah.&#13;
Dan pemilihan Kepala Daerah. Kedua pesta demokrasi tersebut selalu&#13;
menyisakkan berbagai persoalan hukum. Salah satunya adalah terkait politik&#13;
uang.&#13;
Objek tulisan pada penelitian kali ini adalah terkait politik uang dalam&#13;
pemilihan kepala daerah. Sebagaimana regulasi yang telah ada, dapat&#13;
dikatakan bahwa undang-undang pilkada yang berlaku ini adalah yang lebih&#13;
baik dalam mengatur pelanggaran politik uang jika dibandingkan dengan&#13;
regulasi sebelumnya. Sekalipun demikian undang-undang terkait pilkada jelas&#13;
belum dapat dikatakan sempurna.

The 1945 Constitution has been amended four times, the changes that have occurred are&#13;
considered more nuanced in terms of political needs. The 1945 Constitution as the highest&#13;
law that should be able to become the voice of the people is dominated by the tug of war&#13;
interests of political parties. Article changes are only articles related to the authority of the&#13;
head of government and Indonesian institutions. Therefore, the Constitution of the Republic&#13;
of Indonesia is substantially and procedurally not able to touch the needs and participation&#13;
of the community. If you look at Law Number 17 of 2014 concerning the People's&#13;
Consultative Assembly, the People's Representative Council, the Regional Representatives&#13;
Council, and the Regional People's Representative Council, the actual need for community&#13;
participation is part of the tasks of the MPR, but until now the task of the mandate of the law&#13;
is completely has not been able to be implemented.
Sebagaimana difahami bahwa konstitusi merupakan hukum dasar yang dijadikan&#13;
landasan dalam penyelenggaraan negara. Sebagai hukum dasar, konstitusi dapat berbentuk&#13;
tertulis dan tidak tertulis. Konstitusi yang tertulis di Indonesia disebut dengan UndangUndang Dasar. Konstutisi mempunyai peran untuk mempertahankan esensi keberadaan&#13;
sebuah negara dari pengaruh berbagai perkembangan yang bergerak dinamis. Oleh karena itu,&#13;
konstitusi yang ideal merupakan hasil dari penyesuaian dan penyempurnaan untuk mengikuti&#13;
segala perkembangan, khususnya yang berkaitan dengan keinginan hati nurani rakyat.

The dissolution of political parties in Indonesia has its own problems. This problem&#13;
can be seen from the conditions required in the Law on the Constitutional Court&#13;
and the Law on Political Parties relating to matters that can dissolve political&#13;
parties. These requirements are considered not to have a good foundation in&#13;
dissolving political parties, even appearing that they cannot touch on substantive&#13;
matters so that political parties can be dissolved. Apart from that, there is a much&#13;
more important problem that is not touched by the law, but in fact damages the&#13;
value of the goals of political parties and the state in general, namely corruption.&#13;
Therefore, this paper will discuss the substantive weaknesses of the requirements&#13;
proposed by the two laws above. So that in addition to adding a new repertoire of&#13;
legal science in Indonesia, especially in the field of constitutional law. This paper&#13;
is also expected to provide new ideas on the requirements for the dissolution of political parties in Indonesia. The method used in this paper is normative juridical,&#13;
with the data source used is secondary data sources consisting of primary legal&#13;
materials, secondary legal materials and legal materials. tertiary. This research&#13;
was also conducted using several approaches, such as; statutory approach,&#13;
conceptual approach, historical approach.
Salah satu problematika ketatanegaraan yang belum terselesaikan secara baik&#13;
adalah terkait pembubaran partai di Indonesia. Problematika ini mucul ketika&#13;
pembubaran partai politik di Indonesia tidak memiliki parameter yang jelas dalam&#13;
sistem hukum Indonesia. Selain itu aturan yang telah ada terkait hal-hal yang dapat&#13;
menyebabkan bubarnya partai politik mengalami disharmonisasi antara UndangUndang Mahkamah Konstitusi dan Undang-Undang Partai Politik.
